These Terms of Service ("Terms") govern your access to and use of the Apex BTC-5m Council API and website (the "Service"), a product of Trelyan ("Trelyan", "we", "us"), a company organized in the United States. By registering for an API key or using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service is analytics and educational software. It simulates, backtests, and statistically evaluates trading strategies for Bitcoin 5-minute prediction markets. The Service does not place real trades, execute orders, custody funds, or provide brokerage of any kind. All trading output is hypothetical and paper-only.
Nothing the Service produces is investment, financial, legal, or tax advice, or a recommendation to buy, sell, or hold any asset. Outputs are simulations based on assumptions you supply and may not reflect real market conditions, fees, slippage, or liquidity. You are solely responsible for any decision you make. Trading prediction markets and crypto assets carries a high risk of total loss and may be restricted or illegal in your jurisdiction.
You must provide a valid email to obtain an API key. You are responsible for keeping your key secret and for all activity under it. Do not share, resell, or expose your key. Notify us promptly of any unauthorized use.
You agree not to: (a) exceed or circumvent the rate limits or tier restrictions of your plan; (b) reverse engineer, resell, or sublicense the Service except as expressly permitted; (c) use the Service to violate any law or third-party right; (d) attempt to disrupt or gain unauthorized access to the Service or its infrastructure; or (e) use automated means to create multiple free accounts to evade limits.
Paid tiers (Pro, Enterprise) are billed in advance on a recurring monthly or annual basis through our payment processors, Stripe (card) and NOWPayments (crypto). By upgrading you authorize recurring charges (for card subscriptions) until you cancel. Prices are stated on the pricing page and may change with notice. You can manage or cancel a card subscription at any time via the billing portal; cancellation takes effect at the end of the current billing period.
All fees are non-refundable. Payments, including monthly and annual subscription fees and one-time crypto payments, are not refundable except where required by applicable law. Cancelling stops future charges; it does not refund the current period.
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. Free tiers carry no uptime commitment; any SLA applies only to plans that expressly include one.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any analysis, signal, or result is accurate, complete, or will produce any financial outcome.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading, investment, or financial losses, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold us harmless from any claim or demand arising out of your use of the Service or violation of these Terms.
We may suspend or terminate your access for violation of these Terms or for any reason with reasonable notice. You may stop using the Service at any time.
We may update these Terms; material changes will be posted here with a new "Last updated" date. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the United States and the State in which Trelyan is organized, without regard to conflict-of-law rules. The state and federal courts located there have exclusive jurisdiction over any dispute, and you consent to that venue.
